When to Hire a Lawyer or Gestor in Spain: A Practical Guide for British Expats
Spanish bureaucracy is not designed for DIY. The forms are in Spanish, the rules vary by region, and the unwritten procedures are often more important than the written ones.
But hiring help in Spain is not straightforward either. There are three main types of professionals you might need — lawyers (abogados), administrative agents (gestores) and tax advisers (asesores fiscales) — and they do different things, charge differently and are regulated differently.
This article explains when you need each one, what they do, what they cost and how to avoid the common traps that catch British expats.
The Three Types of Professional
1. Abogado (Lawyer / Solicitor)
What they do: Legal advice, contract review, property conveyancing, court representation, immigration applications, disputes, inheritance law.
When you need one:
- Property purchase or sale
- Immigration applications (visa, TIE, residence appeals)
- Contract disputes (rental, employment, service)
- Family law (divorce, custody, inheritance)
- Criminal matters
- Any situation where legal rights are at stake
Qualifications: Must be registered with the Colegio de Abogados (bar association) in their region. Check their registration.
2. Gestor Administrativo (Administrative Agent)
What they do: Bureaucratic procedures, form submissions, appointment bookings, licence applications, tax filings, vehicle registrations, business set-up. They are not lawyers but they know the system.
When you need one:
- NIE application or renewal
- TIE appointment and document submission
- Padrón registration
- Vehicle import and registration
- Business licence applications
- Tax filings (if your situation is simple)
- Social security registration (autónomo)
- Any procedure that requires navigating Spanish administration
Qualifications: Must be registered with the Colegio de Gestores Administrativos. A good gestor is often more useful for admin than a lawyer is.
Important: A gestor cannot give legal advice. If your situation involves legal rights, disputes or complex interpretation, you need a lawyer.
3. Asesor Fiscal (Tax Adviser)
What they do: Tax planning, tax filings, double taxation treaty advice, Beckham Law applications, wealth tax planning, business tax structure.
When you need one:
- First tax year in Spain (Modelo 720 foreign asset declaration, resident tax return)
- Beckham Law assessment and application
- Business tax structure
- Property rental tax
- Wealth tax (patrimonio) planning
- Any situation with complex cross-border tax implications
Qualifications: Often economists or accountants registered with tax professional bodies. Some are also abogados.

Common Traps
Trap 1: Using an Unqualified "Fixer"
Some people advertise "visa services" or "NIE help" without being registered professionals. They may be cheaper, but they have no professional insurance, no regulatory oversight and no accountability. If they make a mistake, you bear the consequences.
Rule: Always verify registration.
Trap 2: Expecting a Lawyer to Do a Gestor's Job
A lawyer who charges €200/hour should not be filling in NIE forms. That is a waste of your money and their expertise. Use the right professional for the right task.
Trap 3: Not Getting a Second Opinion on Major Decisions
If a lawyer says your visa application will definitely succeed, or a tax adviser says the Beckham Law will definitely save you money, get a second opinion. No professional should guarantee outcomes.
Trap 4: Assuming English Is Enough
Even in tourist areas, Spanish administration operates in Spanish. Forms, appointments, phone calls, official letters — all in Spanish. A professional who works only in English may struggle with the Spanish system.
Ideal: A professional who speaks English to you and Spanish to the system.
